Terms & Conditions

These Terms govern your relationship with the operator of the website available at https://casinonicwin-aussie.com in connection with your use of the Casinonic services (the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, you must not use the website or open an account. These Terms are effective as of 1 January 2026 and replace all prior versions.

Definitions

  • Operator means Dama N.V., a company registered under the laws of Curaçao with registration number 152125, having its registered and legal address at Scharlooweg 39, Willemstad, Curaçao, holder of Curaçao e-gaming licence no. 8048/JAZ2020-013 issued by Antillephone N.V., operating the website https://casinonicwin-aussie.com and the Casinonic Services.
  • Website means the online gambling platform accessible at https://casinonicwin-aussie.com and any sub-pages, mirrors, mobile versions, or related online interfaces through which the Casinonic Services are offered.
  • Services means all remote gambling, betting, casino, live casino, promotional and related services provided by the Operator via the Website, including access to games supplied by third-party providers.

Account Registration

Eligibility and age requirements

  • Minimum age: You may only register and use an Account if you are at least 18 years old and have reached the legal age for gambling in your jurisdiction. By registering you represent and warrant that:
    • you are 18 years of age or older; and
    • online gambling is lawful in your country and state/territory of residence; and

Registration process

KYC and verification

  • Mandatory verification: The Operator may, at any time, request KYC documentation, which may include:

    • evidence of source of funds or source of wealth where reasonably required.
  • Timing: Verification may be required prior to:

    • processing withdrawals; or
    • continuing use of the Account where suspicious activity is detected.
  • Failure to comply: If you do not provide accurate, complete, and legible documents within the timeframe notified, the Operator may suspend or close your Account, void Bonuses, and withhold payments until verification is completed, subject to applicable law.

User obligations

  • Accuracy of data: You must ensure that all information provided during registration and throughout the use of your Account is accurate, complete, and kept up to date. You must promptly notify the Operator of any changes to your details.
  • Password security: You are responsible for maintaining the confidentiality of your login credentials. Any activity conducted under your username and password will be deemed to have been carried out by you. You must:
    • keep your password secure and not disclose it to third parties; and
    • immediately notify the Operator if you suspect unauthorised access.
  • Account use: You must not:
    • allow any other person to access or use your Account;
    • use another person's identity or Payment Method without authorisation; or
    • act as an agent, intermediary, or in concert with others to circumvent limits, restrictions, or KYC procedures.

Betting & Gameplay Rules

General gameplay conditions

  • Game rules: Each game available on the Website is governed by its specific rules as displayed within the game or in its information section. By placing a Bet you acknowledge that you have read and understood the relevant game rules.
  • Randomness and fairness: Outcomes of games (other than live dealer games) are determined by a random number generator (RNG) certified under the Curaçao licensing framework. Live dealer game outcomes are determined by actual physical events (e.g. cards, wheels) conducted by the relevant game provider.

Placing bets and limits

  • Bet placement: A Bet is considered placed when it has been accepted by the Operator's servers and appears in your game or transaction history. You are responsible for ensuring that Bet details are correct before confirmation.
  • Minimum and maximum stakes: Each game has specific minimum and maximum stakes, which are displayed within the game interface. The Operator may:
    • adjust stake limits for individual Players or games; and

  • Bet acceptance and refusal: The Operator reserves the right to refuse all or part of any Bet, to limit the maximum payout per Bet or per Player, and to void Bets where required by law or these Terms.

Modification and cancellation of bets

  • Irreversibility: Once a Bet has been confirmed by the system, it cannot normally be amended, withdrawn, or cancelled by the Player.
  • Obvious errors: In the event of an obvious error (including but not limited to technical malfunction, displayed odds or pay-tables that are manifestly incorrect, or game misconfiguration), the Operator may:
    • void affected Bets and return the original stake; or
    • recalculate results based on correct settings where objectively determinable.
  • Interrupted games: If a game is interrupted due to technical or network failure on the Operator's side, the Operator will:
    • endeavour to restore the game state to the last known confirmed position; or
    • where restoration is not possible, void the game and refund the stake to the Real Money Balance.

Conduct in live casino and chats

  • Behaviour standards: When using live casino, chat functions, or interacting with dealers, staff, or other Players, you must:
    • refrain from insults, harassment, threats, discrimination, or obscene language;
    • not disseminate spam, advertisements, or unlawful content; and
    • respect the privacy and rights of other Players and staff.
  • Prohibited practices: You must not engage in:
    • collusion with other Players or third parties;
    • fraud, cheating, use of bots, scripts, or automated systems;
    • exploitation of bugs, loopholes, or malfunctions in games or the Website; or
    • money laundering, terrorist financing, or any other unlawful activity.
  • Enforcement: The Operator may suspend chat access, void Bets, withhold winnings, or close Accounts in the event of abusive conduct, suspected fraud, or breaches of these rules, subject to applicable law and any mandatory consumer protections.

Bonus Terms

General bonus conditions

  • Bonus offers: From time to time the Operator may offer Bonuses and promotions on the Website. Each promotion is subject to these Terms and to its specific promotional terms and conditions published on the Website at the time of the offer.
  • Personal and non-transferable: Bonuses are intended solely for the registered Player to whom they are granted and cannot be sold, transferred, or exchanged for other benefits unless explicitly stated.

Activation and wagering requirements

  • Activation: To activate a Bonus you may be required to:
    • opt in by selecting the Bonus at the cashier or in your profile; and/or
    • enter a bonus code; and/or
    • make a qualifying deposit meeting specified minimum deposit thresholds.
  • Standard wagering: Unless otherwise stated, Bonuses and winnings derived from Bonuses must be wagered a specified number of times (e.g. 30x - 50x the Bonus amount or the sum of Bonus and deposit) within a defined timeframe (typically up to 30 days, but in any case no later than 31 December 2026 for time-limited campaigns) before they can be withdrawn as Real Money Balance.

Prohibited gameplay and bonus abuse

  • Abuse and fraud: Bonus abuse includes, but is not limited to:

    The Operator may remove Bonuses, forfeit associated winnings, and close Accounts involved in abuse, subject to applicable law.

Combining promotions and bonus funds

  • No automatic combination: Unless expressly allowed, different promotions cannot be combined. Only one active Bonus may apply to your Account at any given time.
  • Bonus and real money priority: Real Money Balance may be used before Bonus funds, or vice versa, as specified in the applicable bonus rules displayed on the Website. The order of use affects which funds are withdrawable.
  • Expiry: Bonuses and associated winnings may expire if wagering requirements are not met within the stipulated period. Upon expiry, remaining Bonus funds and related winnings will be removed from your Account.

Payments & Withdrawals

  • Processing times: Deposits are generally processed instantly but may experience delays due to third-party payment processors, banking systems, or compliance checks.

Withdrawal procedures

  • Withdrawal requests: You may request withdrawals from your Real Money Balance via the "Cashier" or equivalent section, subject to:
    • completion of any applicable wagering requirements;
    • successful completion of KYC and other verification; and
    • compliance with these Terms and any applicable law.
  • Method of payment: Where possible, withdrawals will be processed back to the same Payment Method used for deposit. If that is not feasible, the Operator may agree an alternative method subject to additional verification.
  • Limits and timelines: The Operator may apply:
    • minimum and maximum withdrawal amounts per transaction;
    • daily, weekly, or monthly withdrawal limits; and

Fees, chargebacks and refunds

  • Fees: The Operator may charge reasonable processing fees for certain deposit or withdrawal methods, which will be disclosed in the cashier interface or within these Terms where applicable. Third-party providers may also charge their own fees.
  • Chargebacks: If a deposit is subject to chargeback, reversal, or cancellation:
    • the Operator may deduct the corresponding amount, and any related costs or fees, from your Account balance;
    • any winnings generated from such funds may be voided; and
    • your Account may be suspended or closed pending investigation.
  • Refunds: Refunds of Bets, deposits, or Bonuses are granted at the Operator's discretion and only in exceptional circumstances, such as technical errors attributable to the Operator or mistaken duplicate deposits. Where a refund is granted, it will normally be processed to the original Payment Method.

Currency and crypto-assets

  • Account currency: Your Account may operate in one or more supported fiat currencies and/or cryptocurrencies, as indicated on the Website. Currency conversion rates are determined by the Operator or its payment providers.
  • Cryptocurrency risks: Where cryptocurrencies are accepted, you acknowledge the inherent volatility and technical risks of such assets. Deposits and withdrawals in crypto may be subject to blockchain confirmation times and network fees beyond the Operator's control.

Limitation of Liability

Operator obligations

  • Provision of services: The Operator will provide the Services with reasonable skill and care and will use commercially reasonable efforts to:

    • maintain accurate recording of Bets, game outcomes, balances, and transactions; and

Exclusions and limitations

  • Technical failures and interruptions: To the maximum extent permitted by law, the Operator is not liable for:
    • interruptions, delays, or unavailability of the Website or Services caused by third-party networks, internet service providers, ACMA blocks, or other external factors;
    • malfunctions of hardware, software, RNGs, or systems not directly controlled by the Operator; or
    • losses resulting from your own device failures, power outages, or failure to maintain secure systems.
  • Indirect losses: To the extent permitted under applicable law, the Operator is not liable for indirect, consequential, special, or punitive damages, including loss of profits, business, data, goodwill, or opportunity arising out of or in connection with your use of the Services.
  • Maximum compensation: Without limiting mandatory statutory rights that cannot be excluded under Australian consumer laws (to the extent those laws apply), the total liability of the Operator to you for any single event or series of related events shall not exceed:
    • the amount of the Bet or Wager that gave rise to the dispute; or
    • if no Bet is involved, the lesser of your aggregate deposits to the Account in the 90 days preceding the event and an amount reasonably proportionate to the loss suffered.
  • No exclusion of mandatory rights: Nothing in these Terms excludes or limits liability for:
    • death or personal injury caused by negligence;
    • fraud or fraudulent misrepresentation; or
    • any other liability that cannot be lawfully excluded or limited under applicable consumer protection laws.

Intellectual Property Rights

Ownership of content and software

  • Operator and licensors: All intellectual property rights in and to the Website, the Casinonic branding as used solely in connection with https://casinonicwin-aussie.com, its content, underlying software, databases, graphics, text, logos, trade names, trademarks, sound, video, and other materials are owned by the Operator or its licensors and are protected by copyright, trademark, and other applicable laws.
  • Third-party providers: Games and related content made available on the Website may be owned by third-party software providers and used by the Operator under licence.

Permitted and prohibited uses

  • Limited licence: Subject to your compliance with these Terms, the Operator grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and Services for your personal, non-commercial entertainment purposes only.
  • Restrictions: You must not, without the prior written consent of the Operator:

Changes to Terms

Amendments and updates

Termination & Suspension

Operator's right to suspend or close accounts

  • Grounds for action: The Operator may suspend or terminate your Account, withhold or void Bets, Bonuses, and winnings, or restrict your access to the Services where it has reasonable grounds to believe that:
    • you have breached these Terms or any game or bonus rules;
    • you have provided false, misleading, or incomplete information;
    • you are underage or located in a Restricted Jurisdiction (including Australia, where offshore gambling services may be blocked by ACMA);
    • you have engaged in fraud, money laundering, collusion, cheating, or other unlawful conduct; or

Player-initiated closure

  • Voluntary closure: You may request closure or self-exclusion of your Account at any time by contacting customer support at [email protected]. The Operator will process such requests within a reasonable timeframe.
  • Remaining funds: Upon permanent closure not related to fraud, chargebacks, or legal violations, the Operator will pay out any remaining Real Money Balance to you, subject to completion of KYC, fulfilment of wagering requirements, and applicable withdrawal limits.

Effect of termination

  • Consequences: Upon termination or closure of your Account for any reason:
    • your right to use the Services ceases immediately;

Governing Law & Jurisdiction

    • if the matter is not resolved, it may be referred to the competent courts of Curaçao, unless mandatory provisions of applicable consumer protection law require otherwise.
  • Local law responsibilities: It is your responsibility to ensure that your use of the Services complies with the laws of your country or state/territory of residence. The Operator does not provide legal advice and does not accept liability for any breach of local laws by Players.
